BY-LAW AMENDMENT C521-2018 (HOUSEKEEPING AMENDMENT)

 

TAKE NOTICE that the Council of the Corporation of the Township of Carling will hold a Public Meeting on September 10, 2018 at 6:00 p.m. at the Council Chambers to inform the public with respect to a proposed zoning by-law amendment under Section 34 of the Planning Act, R.S.O. 1990, c. P13.

 

THE PURPOSE AND EFFECT of the proposed amendments to Zoning By-law No. C500-2011 is to make a number of housekeeping or technical changes including clarifications to definitions and general provisions, and corrections in response to minor errors on the zoning maps.

 

There is no key map attached to this notice given that the provisions of this by-law apply to the whole of the Township.

NOTICE OF A PUBLIC MEETING CONCERNING

PROPOSED ZONING BY-LAW AMENDMENT C521-2018

TOWNSHIP OF CARLING HOUSEKEEPING AMENDMENT

 

 

TAKE NOTICE that the Council of the Corporation of the Township of Carling will hold a Public Meeting on April 9, 2018, at 6:00 p.m. at the Council Chambers to inform the public with respect to a proposed zoning by-law amendment under Section 34 of the Planning Act, R.S.O. 1990, c. P13.

 

THE PURPOSE AND EFFECT of the proposed amendments to Zoning By-law No. C500-2011 is to make a number of housekeeping changes including corrections in response to minor technical errors on the zoning maps. The following general changes to the text of the by-law are proposed:

 

1.      Add “Short Term Accommodation” as a definition in Section 4;

2.      Amend Section 4.79 – Kitchen definition by adding the words “or sink” to the end of the definition;

3.      Amend Section 5.01 to clarify the structures and buildings permitted in the front yard of a waterfront residential lot;

4.      Amend Section 5.20 b) to clarify that hunting camps or syrup operations may front upon a road over Crown Land;

5.      Amend Section 5.38 by removing the words “except in accordance with Special and Temporary Uses.”

6.      Amend Section 5.45 to clarify that fences and gates are prohibited from encroaching into any front yard in a waterfront residential zone; and

7.      Amend Section 5.47 to include Short Term Accommodations as a prohibited use in all residential zones.

8.      Amend Section 5.57 a) to clarify that temporary camps used in the construction of public works are permitted in all zones within the Township but only for a maximum of 2 years from the date of commencement of construction or until construction has been completed or abandoned.

9.      Amend Section 5.57 b) to clarify that a tool shed, scaffold or other building or structure are only permitted for a maximum of two (2) years from the date of commencement of construction or until construction is completed or abandoned.

10.   Amend Section 5.57 c) to include a sentence that says, “a travel trailer may be used for human habitation during the construction of a principal use dwelling for up to a maximum of two (2) years from the date of issuance of a building permit or until construction is abandoned”.

11.   Amend Section 5.58 by adding the words “except in accordance with the special and temporary uses outlined in Section 5.57” to the end of the provision.

ANY PERSON may attend the Public Meeting and make written and/or verbal representation either in support of or against the proposed zoning by-law amendment.

 

IF A PERSON or public body does not make oral submissions at a public meeting or make written submissions to the Township of Carling before the by-law is passed, the person or public body is not entitled to appeal the decision of the Council of the Township of Carling to the Ontario Municipal Board.

 

IF A PERSON or public body does not make oral submissions at a public meeting or make written submissions to the Township of Carling before the zoning by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

THE CORPORATION OF THE TOWNSHIP OF CARLING

BY-LAW NO. C521-2018

 

Being a By-law to amend Township of Carling

By-law No. C500-2011

 

WHEREAS the Council of the Township of Carling enacted By-law No. C500-2011 to regulate the use of land within the Township of Carling; and

 

WHEREAS Council has the authority pursuant to Section 34 of the Planning Act R.S.O. 1990, Chapter P.13 as amended, to pass amendments to the Zoning By-law; and,

 

WHEREAS Council deems it necessary and appropriate to make a number of housekeeping changes to the Zoning By-law;

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF CARLING ENACTS AS A BY-LAW OF THE CORPORATION AS FOLLOWS AS AMENDMENTS TO BY-LAW C500-2011:

 

1.       Section 4 Definitions

 

Amend Section 4 by replacing Section 4.79 – “Kitchen” definition with the following new definition:

 

4.79 “means a room or part of a room where food is stored or prepared or cooked, or which has cooking facilities or a sink”.

 

Amend Section 4 by adding the following definition as Section 4.132:

 

4.132 “Short Term Accommodation” means a dwelling or structure or any part thereof that operates or offers a place of temporary residence, lodging, or occupancy for any period of less than thirty (30) calendar days, throughout all or any part of a calendar year. Short term accommodation shall not mean or include a motel, hotel, bed and breakfast establishment, commercial resort unit, or similar commercial or institutional use.

 

2.       Section 5.01 Accessory Buildings and Structures

 

Amend Section 5.01 b) by replacing the words “shall not exceed one storey” with the words “shall not exceed one and one half storey, where the half storey is used for the purposes of human habitation in the form of a sleeping cabin above the accessory building or structure”;

 

Amend Section 5.01 by adding the following new section as Section 5.01 c):

 

5.01 c) Notwithstanding sub-paragraph (b) above, one sauna, one gazebo, or one storage shed, along with one pump house may be located in the front yard of any lot zoned for waterfront residential use, provided that the building or structure complies with all other provisions of this by-law.

 

Amend Section 5.01 by adding the following new section as Section 5.01 l):

 

5.01 l) An accessory building or structure may include a half storey located immediately above the building or structure that can be used as a sleeping cabin, subject to all other provisions in this by-law.

 

3.      Section 5.20 Frontage Requirements

 

Amend Section 5.20 (b) by adding the words “or road over Crown Land” after the words “unopened road allowance” and by adding the words “where applicable” at the end of the sentence.

 

4.      Section 5.38 Mobile Home

 

Amend section 5.38 by removing the words “except in accordance with Special and Temporary Uses”.

 

5.       Section 5.45 Permitted Encroachments

 

Amend Section 5.45 (f) by adding the words “except in any waterfront residential zone”.

 

6.       Section 5.47 Prohibited Uses

 

Amend Section 5.47 by adding the following new section as Section 5.47 k):

 

6.47       k) Short term accommodation in any residential zone

 

7.       Section 5.57 Special and Temporary Uses

 

Amend Section 5.57 a) by adding the words “for up to a maximum of two years from the date of commencement of construction or” after the words “public works”, and by removing the words “but only for so long as it is necessary for such works as may be constructed adjacent to the camp and”.

 

Amend Section 5.57 b) by adding the words “for up to a maximum of two years from the date of commencement of construction or” after the word “situated” and by removing the words “and only for so long as it is necessary for the work in progress and”.

 

Amend Section 5.57 c) to include a sentence that says, “a travel trailer may be used for human habitation during the construction of a principal use dwelling for up to a maximum of two (2) years from the date of issuance of a building permit or until construction is abandoned”.

 

8.       Section 5.58 Special Use Restrictions

 

Amend Section 5.58 by adding the words “except in accordance with the special and temporary uses outlined in Section 5.57” to the end of the provision.

 

8.       Section 9.04.1.57 – Waterfront Residential 1 Exception 57 (WF1-57)

 

Amend Section 9.04.1.57, being Waterfront Residential 1 Exception 57 (WF1-57) by replacing the words “being Part of Part 1, Plan PSR-530 and Part 1 of Plan 42R-17532” with the following words: “being Part 2 of Plan 42R-11740”.

9.      A number of map corrections related to previous rezonings and housekeeping updates are hereby made to the Zoning Schedules and these amendments are illustrated in the replacement Schedules attached to this by-law.
