1.         CALL TO ORDER

The Mayor called the meeting to order at 7:00 p.m.

2.         MINUTES OF THE PREVIOUS MEETINGS

          NOW THEREFORE BE IT RESOLVED that the Minutes of the Regular Meeting of Council held on June 13, 2011, be approved.

COMMITTEE OF THE WHOLE

11-082    Moved by Councillor Murphy    Seconded by Councillor Gordon

         NOW THEREFORE BE IT RESOLVED that the Minutes of the Committee of the Whole held on June 10, 2011, be approved.

3. SHORE ROAD ALLOWANCE

SHORE ROAD ALLOWANCE APPLICATION 2011-7

Applicant:  Richard & Michele Doktor

11-083    Moved by Councillor Konoval     Seconded by Councillor Larson

           NOW THEREFORE BE IT RESOLVED That Carling Council agree to open a file, SRA 2011-7 being an application to close and convey shore road allowance in front of Con C Pt 9, SR G C 0106, and that the shore road allowance to be closed and conveyed be declared surplus pursuant to Property Disposal By-law No. 95-10.  Applicants:  Richard & Michele Doktor, 29 Maurys Run.

SHORE ROAD ALLOWANCE APPLICATION 2011-9

Applicant:  Paul & Caroline Duimering

11-084     Moved by Councillor Gordon     Seconded by Councillor Murphy

           NOW THEREFORE BE IT RESOLVED That Carling Council agree to open a file, SRA 2011-9 being an application to close and convey shore road allowance in front of Con C Pt Lot 54, PCL 7956 SS, and that the shore road allowance to be closed and conveyed be declared surplus pursuant to Property Disposal By-law No. 95-10.  Applicants:  Paul & Caroline Duimering, 59 Alves Rd.

4.         REPORT OF THE CHIEF ADMINISTRATIVE OFFICER

NOW THEREFORE BE IT RESOLVED that Council receives the Reports of the Chief Administrative Officer, as distributed.

NOW THEREFORE BE IT RESOLVED that Council receives the June 2011 Council Correspondence listing.

6. OTHER BUSINESS

TOWNSHIP OF SOUTH FRONTENAC

Recyclable Manufacturing and Packaging

11-087     Moved by Councillor Konoval     Seconded by Councillor Murphy

            WHEREAS the Province has the authority to introduce measures to control the sale of products in Ontario; and

            WHEREAS the Province has set waste diversion rates for municipalities;

AND WHEREAS the Township of Carling supports in principle the resolution of South Frontenac regarding the limiting the manufacturing and packaging to products that can be recycled;

NOW THEREFORE BE IT RESOLVED that the Council for the Township of Carling requesting the Province to introduce legislation that limits the sale of goods sold in Ontario where financially practical to those which are completely recyclable or compostable;

AND FURTHER BE IT RESOLVED that all goods sold in Ontario have packaging regulated in a manner that will minimize the packaging material required and that these packaging materials be completely recyclable or compostable.

BUILDING REPORT - JANUARY 1 to JUNE 30, 2011

NOW THEREFORE BE IT RESOLVED that the Chief Building Officials report dated July 11, 2011 be received for information.

SURPLUS GRADER – 1991 740 Champion Grader

11-089     Moved by Councillor Konoval      Seconded by Councillor Larson

            NOW THEREFORE BE IT RESOLVED that as per By-law 2004-34 Section 12 and as per the recommendation of the Public Works Superintendent, Council for the Township of Carling declare the 1991 740 Champion Grader as surplus and that it be both advertised locally as well as in broader circulation, for sale to the highest bidder, in an as is condition.

OWNERSHIP OF HIGHWAY 559 BETWEEN HWY 7182 & CP TRACKS

11-090     Moved by Councillor Gordon      Seconded by Councillor Larson

            NOW THEREFORE BE IT RESOLVED That Council for the Township of Carling here-by amend Resolution 10-034  to read that Council for the Township of Carling agree to assume ownership of  the section of Highway 559 between Highway 7182 (Shebeshekong Road) and the CP Tracks from MTO with the understanding that this section of road will be decommissioned, that the existing surface be pulverized and a permanent barrier be placed to eliminate further usage of said road, and that MTO be responsible for all aspects of costs associated with the stopping up and closing of the road, as well as its transfer.

           AND FURTHER BE IT RESOLVED that Council agree to the inclusion of a bicycle lane on the section of Nobel Road that is being transferred to the Township of Carling.

Council directed staff to get a letter from the Ministry regarding the Ministry’s comment that the Township would not be bound by their agreement with the MNR for the maintenance requirements of the snake fencing.

SHORE ROAD ALLOWANCE BY-LAW

THAT By-law Number 2011-26, being a By-law to Close and Sell Part of the Original Shore Road Allowance in front of Lot 16, Concession C, Township of Carling (Robertson), be read and finally passed in Open Council this 11th day of July, 2011.

ZONING BY-LAW AMENDMENT C483-2011

Concession D, Pt Lot 13, Plan 42R-8744 Parts 21 & 22,

Plan 42R-12538 Parts 3 & 4 and Plan 42R-13639 Part 1(JOHNSON)

C483-2011       Moved by Councillor Larson      Seconded by Councillor Murphy

THAT By-law Number C483-2011, being a By-Law to amend By-Law No C400-2000, The Zoning By-Law for Concession D, Pt Lot 13, Plan 42R-8744 Parts 21 & 22, Plan 42R-12538 Parts 3 & 4 and Plan 42R-13639 Part 1, be read and finally passed in Open Council this 11th day of July, 2011.

AGREEMENT TO USE ROAD ALLOWANCE

Applicants:  Orest Kalyn et al

Council requested that this item be deferred to the August meeting pending legal clarification on an issue.

 

INVERLOCHY CONDOMINIUM-DEVELOPMENT AGREEMENT

Applicants:  Avalon Properties Limited

2011-27      Moved by Councillor Konoval     Seconded by Councillor Larson

THAT By-law Number 2011-27, being a By-law to authorize the execution of a Development Agreement between Avalon Properties Limited and the Corporation of the Township of Carling with respect to a Vacant Land Condominium Plan for Inverlochy Resort and Associated Lands (Inverlochy Condominium), be read and finally passed in Open Council this 11th day of July, 2011.

Carried.

8. REPORT OF THE COMMITTEES

Councillor Konoval reported on the REDAC meetings and asked staff to investigate the financial costs and commitments for the Township becoming a member.

Councillor Konoval thanked Council and staff for the excellent Public Meeting that was held on the Township Building Project.

Councillor Murphy reported on the Museum Board and its recruitment process for a Curator. The recruitment process will have to be repeated and the major issue is the salary being offered.

Councillor Murphy reported that the Parry Sound Library Boards recruitment process for a CEO has gone well and that the position is being offered to an excellent candidate.

Councillor Murphy reported that there was no meeting this month for Belvedere.

Councillor Murphy also reported on her attendance at a REDAC meeting and felt that the quality of the non-political representation bode well for the committee.

Councillor Gordon reported that Webber Construction should be completing the remaining work on the Carling portion of the trail by mid-August.

Councillor Gordon reported that the Planning Board meeting was cancelled.

Councillor Larson reported no update for the Industrial Park.

Councillor Larson reported that he has been receiving excellent comments regarding the new Fire Boat. A general discussion took place regarding possible ribbon cutting ceremonies.

Mayor Harrison reported that a deal for a new company was close to being finalized in the Industrial Park and that a meeting with the MTO is to take place regarding their traffic study requirements.

Mayor Harrison reported on the resent Heads of Council meeting and the areas support for hosting the FONOM Conference in 2013.

Mayor Harrison reported on a meeting he had with the Mayor of Parry Sound and the possibility of a film studio being set-up locally.

9. CLOSED MEETING

           NOW THEREFORE BE IT RESOLVED that Council move into a CLOSED MEETING at 7:21 p.m., pursuant to Section 239(2) of the Municipal Act, 2001,S.O. 2001, c.25, as amended to deal with personnel matters.

           NOW THEREFORE BE IT RESOLVED that Council move out of a CLOSED MEETING at 7:37 p.m.

         THAT By-Law Number 2011-28, being a Confirming By-Law, be read and finally passed in Open Council this 11th day of July, 2011.
