1.    CALL TO ORDER

The Mayor called the meeting to order at 7:00 p.m.

2.    PUBLIC MEETING

ZONING BY-LAW AMENDMENT C511-2014

Mayor Harrison called the public meeting to order and read out the purpose and the effect of the by-law as set out below.

THE PURPOSE of the proposed zoning by-law amendment is to rezone Pt Lot 75, Concession 12, Part 1 of Plan PSR-439, Part 3 of Plan 42R-9115, known municipally as 9 Adam Brown Rd., to recognize the existing undersized lot as a lot of record and allow development on the lot.

THE EFFECT of the proposed zoning by-law is to deem the lot to conform with the Zoning By-law which would allow development of the lot.  The existing lot meets all the requirements of Comprehensive Zoning By-law C500-2011, except for the 1800 square metres of required area and 60 metres of required depth.  The existing lot has an area of approximately 1497 square metres and a depth of 52 metres.

The Deputy Clerk advised Council that the notice requirements of the Planning Act had been met and that four letters of objection were received in the Municipal office with respect to the proposed rezoning.

The Mayor asked if there was anyone present who wished to address council with respect to the proposed by-law.

Mr. Chambers, an abutting neighbour expressed his objection to the proposed zoning by-law amendment explaining that any development of the Laurie property would have a negative impact on his enjoyment of his property.  Mr. Chambers also relayed to Council that he would be interested in purchasing the property and adding it to his lot if a reasonable price could be agreed.


Peter Laurie conveyed to Council the history of the subject property, which was created by his family prior to Carling Township having a zoning by-law, with intentions to someday develop it.  Under the current zoning by-law the property does not meet the criteria for development.  He explained that the family would like to sell the property to create a maintenance fund for their other family cottage property and that without a zoning amendment, allowing the lot to be developed, it makes it very difficult to sell.

Glenn Robison was in attendance for another matter on the agenda, but spoke to Council about the possibilities of the subject property merging with the Chambers property should they purchase it.  

Mayor Harrison declared this portion of the public meeting closed.

3.    MINUTES OF THE PREVIOUS MEETING

6.    SHORE ROAD ALLOWANCES

NOW THEREFORE BE IT RESOLVED That Carling Council agree to open a file, SRA 2014-3 being an application to close and convey the shore road allowance in front of Plan M171, Lot 248, PCL 26702, and that the shore road allowance to be closed and conveyed be declared surplus pursuant to Property Disposal By-law No. 95-10.  Applicants:  David & Susan Gower, 43 Ridgeway Drive.

7.    REPORT OF THE CHIEF ADMINISTRATIVE OFFICER

8.    REPORT OF THE COMMITTEES

    Councillor Konoval reported that he attended the Celebrate Carling event on September 13th.

    Councillor Konoval reported that he attended the All Candidates Meeting on September 20th.

    Councillor Konoval also reported that on September 26th he attended the Fall District of Parry Sound Municipal Association Meeting.  Presenters included Dave  Thompson, Fire Chief and Director of Emergency Services with the Town of Parry Sound, who spoke about the EMS situation, Susan Shannon of MuniSERV, and Terri-Lynne Bannon with MPAC.

    Councillor Konoval reported that he attended the West Parry Sound Health Centre Board Meeting on September 29th and learned that they are renovating the Palliative Care Unit and looking for a new general surgeon.

    Councillor Murphy relayed to Council that the HVAC system at the Museum is still not complete.  

    Councillor Murphy reported that Belvedere Heights is getting a new roof.

    Councillor Murphy reported that the Library Board is applying to the Trillium Fund for a new floor, ceiling and other renovations.

    Councillor Larson reported to Council that he attended the Parry Sound Industrial Park Board meeting on October 9th and relayed that the water/sewer services on Helen Crawford Drive are complete, the lagoons are working well and the metering systems are up and running.

    Councillor Gordon reported to Council that he attended the Parry Sound Active Transportation Committee.

    Mayor Harrison relayed to Council that Redac is working on a marketing plan which they hope will move things forward.

10.    OTHER BUSINESS

AMO POLICY UPDATE.  DOUBLE HATTER FIREFIGHTER

WHEREAS the training and certification of professional firefighters is established and mandated by the Province of Ontario under the Fire Protection and Prevention Act, 1997;

AND WHEREAS it is the responsibility of municipalities to establish fire departments and appoint fire chiefs to provide fire protection services as they determine may be necessary in accordance with their needs and circumstances;

AND WHEREAS many Ontario municipalities rely on both full time and volunteer firefighters in order to provide fire protection;

AND WHEREAS the International Association of Fire Fighters (“IAFF”) Constitution prohibits full time firefighters from volunteering as firefighters in another municipal jurisdiction (i.e. “Double Hatting”);

AND WHEREAS the IAFF’s stance on Double Hatting is specifically prohibited by legislation in almost all provinces in Canada and much of the United States;

AND WHEREAS a volunteer firefighter in the Innisfil Fire and Rescue Service is challenging the IAFF ban on Double Hatting and their expulsions from that union because of his desire to continue volunteering while being employed as a full-time firefighter in another jurisdiction;

AND WHEREAS the right of individuals to use their free time in service of their community is a fundamental right in a free, open and democratic society;
    
NOW THEREFORE BE IT RESOLVED that the Council of the Township of Carling requests that the Province of Ontario amend the Fire Protection and Prevention Act, 1997 with respect to salaried firefighters who also work as volunteer firefighters, such that if a person is denied membership in an association of firefighters, is expelled or disciplined by the association or engages in reasonable dissent within the association in connection with this kind of dual role, the association is not permitted to require the employer to refuse to employ the person as a salaried firefighter, terminate his or her employment as a salaried firefighter or refuse to assign the person to fire protection services.

BE IT FURTHER RESOLVED that this resolution be circulated to Hon. Kathleen Wynne, Premier of Ontario; Hon. Madeline Meilleur, Attorney General; Hon. Kevin Flynn, Minister of Labour; Hon. Yasir Naqvi, Minister of Community Safety and Correctional Services and Hon. Ted McMeekin, Minister of Municipal Affairs and Housing.

PLAQUES FOR ADMINISTATION BUILDING AND PUBLIC WORKS GARAGE

That By-law Number 2014-44, being a By-law to confirm the proceedings of the Regular Meeting of Council held on October 14, 2014 be read and finally passed in Open Council this 14th day of October, 2014.
